Definitions: (a) “Company” refers to LOGX Transport Express Ltd. (b) “Goods” refers to any documents or items (including containers and packaging) consigned by a Customer from one address to another. (c) “Customer” refers to any individual, company, legal entity, or organisation that consigns Goods.
Acceptance of Terms: LOGX Transport Express is not a common carrier and accepts Goods exclusively under these Terms and Conditions. No employee or agent of the Company has the authority to modify or waive any clause of this Contract.
Customer Responsibilities: The Customer irrevocably warrants that: (a) They are the owner of the Goods or are acting as the duly authorised agent of the owner; (b) The Goods are accurately described before acceptance for transportation; (c) The Goods do not include weapons, ammunition, or explosives; (d) The Goods do not include correspondence that is exclusively delivered by the UK postal service; (e) The Goods do not include drugs, documents, or items that are illegal in the UK or any other country; (f) The Goods do not include items whose export or import is prohibited by applicable laws; (g) Any toxic, corrosive, flammable, or hazardous Goods have been previously disclosed in writing to LOGX Transport Express; (h) The Goods are properly packed in compliance with applicable regulations if the packaging is provided by the Customer.
Payment: The Customer must pay LOGX Transport Express in accordance with the prevailing tariff rates, which are available upon request. Payment must be made within 15 days from the invoice date. Late payments will incur an administrative fee of £45.00, plus monthly interest at the Bank of England Base Rate + 8%.
Duties and Taxes: If LOGX Transport Express pays any duties, taxes, or levies related to the Goods, the Customer: (a) Agrees that the Company is acting as their authorised agent when making such payments; (b) Must fully reimburse LOGX Transport Express upon receipt of the corresponding invoice; (c) Will be subject to the penalties outlined in Clause 15 in the event of non-payment.
Insurance: LOGX Transport Express does not provide insurance coverage unless expressly requested in writing before acceptance of the Goods. Coverage will only be valid upon written confirmation from LOGX Transport Express and will be subject to the insurer’s terms and conditions.
Transport and Delivery: LOGX Transport Express may transport the Goods: (a) Directly or via third-party partners; (b) By any suitable means of transport; (c) By any available route.
Failure to Deliver: If delivery to the designated address is not possible: (a) LOGX Transport Express will attempt to contact the Customer to obtain an alternative delivery address; (b) If no response is received within a reasonable time, the Company may dispose of the Goods as per Clause 15 or destroy them.
Limitation of Liability: LOGX Transport Express’s maximum liability for loss, damage, misdelivery, or delay will be the lesser of: (a) The declared value on the consignment note; (b) Three times the transport fee charged; (c) £50.00. Additionally: (i) No compensation will be payable for indirect or consequential loss; (ii) The Customer must report any incident by registered letter within 3 days of becoming aware of it; (iii) Any legal action against LOGX Transport Express must be initiated within 2 years of the incident; (iv) LOGX Transport Express is not liable for events beyond its control, including but not limited to natural disasters, strikes, mechanical failures, government actions, or customs delays.
Indemnity: The Customer shall indemnify LOGX Transport Express against any costs, claims, or expenses arising from the transportation of the Goods, including customs charges, legal disputes, or extraordinary administrative costs.
Right of Retention: LOGX Transport Express has the right to retain Goods until all outstanding amounts are settled. If payment is not received within a reasonable time, the Company may sell the Goods and apply the proceeds towards outstanding balances.
Governing Law: This contract is governed by the laws of the United Kingdom, and any disputes shall be resolved exclusively in the English courts.
